Terms of Use

1. Purpose

These Terms of Use (hereinafter referred to as the "Terms") define the conditions of access to and use of the Creation Africa platform, available online at https://www.creationafrica.com/en/ (hereinafter referred to as the "Platform").

The Platform allows users to consult, publish, and apply to calls for applications.Use of the Platform constitutes unconditional acceptance of these Terms.

2. Platform Operator

The Platform is made available to users under the responsibility of the Groupement d’Intérêt Public (GIP) MISSION DE PREFIGURATION DE MANSA – MAISON DES MONDES AFRICAINS. 

3. Services Offered

The Platform provides the following services:

  • Public access to calls for applications published by the editorial manager and its authorized partners;
  • Creation of user accounts to respond to calls for applications;
  • Monitoring of the status of submitted applications.

These services are provided free of charge. The Platform is provided "as is", with no guarantee of continuous availability or freedom from errors. The operator undertakes to make reasonable efforts to ensure quality service, within the limits of technical and financial constraints.

4. Responsibilities

The user (applicants) agrees to:

  • Use the Platform in compliance with these Terms and applicable laws;
  • Provide accurate information when registering and submitting applications.

The user (partner authorized to publish calls for applications) agrees to:

  • Use the Platform in compliance with these Terms and applicable laws;
  • Publish calls for applications in accordance with applicable legal and regulatory obligations, in particular those relating to the protection of personal data.

The operator shall not be held liable for:

  • The use made by users of the services provided;
  • Temporary service interruptions due to maintenance or events beyond its control;
  • Content published by users.

5. Prohibited Content

Any content or statements published via the Platform—particularly in free text fields, as well as in attachments or supporting documents submitted as part of an application—must comply with applicable laws.

The following content or statements are strictly prohibited:

  • Any hateful, discriminatory, or violent content, or incitement to commit unlawful acts, including racist, sexist, homophobic, or xenophobic content;
  • Any defamatory, slanderous, offensive, threatening, or denigrating content directed at other users, third parties, or institutions;
  • Any knowingly false or misleading content (identity theft, falsified information, etc.);
  • Any advertising or promotional content intended to promote a candidate, organization, institution, or third party;
  • Any political or ideological content, or content expressing hostility toward States, institutions, or public officials — except for political or ideological statements that are strictly framed and contextualized within an artistic performance project falling within the scope of cultural and creative works;
  • Any religious or ideological content intended to impose a belief, opinion, or cultural practice (proselytism);
  • Any content irrelevant to the purpose of the Platform, fanciful, or intended to disrupt or divert the Platform's objectives;
  • Any content infringing upon third-party copyright or intellectual property rights.

Users are also advised to exercise caution when publishing personal information on the Platform.

The operator reserves the right to remove any non-compliant content without notice and, where appropriate, to deactivate the account of the user concerned.

6. Personal Data

The processing of personal data in connection with use of the Platform is governed by the Privacy Policy.

Users may consult the Privacy Policy to understand how their personal data is processed, identify the data controllers, and learn about their rights and how to exercise them.

7. Amendments to the Terms

These Terms are subject to change, particularly in the event of service updates or legal/regulatory developments. 

Users will be informed of any substantial modifications to the Terms via the Platform. Continued use of the services after such changes constitutes acceptance of the updated Terms.

8. Governing Law – Dispute Resolution

These Terms are governed by French law.

In the event of a dispute, users may file a complaint with the operator. Failing an amicable resolution, the matter may be referred to the competent courts.
